TERMS OF SERVICE

1. CASE DESCRIPTION

The proposed engagement of legal services is for those flowing directly from this internet web site offer. The proposed client herewith retains, when payment is made, REGINALD W. SMITH ATTORNEY AT LAW to represent client in the matter of a non-contested Alabama divorce. A non-contested divorce is defined as both parties are and remain in full agreement to all issues being submitted to the Court at all times to and including the Court issuing a Final Judgment of Divorce. If at any time prior to the Court issuing a Final Judgment of divorce one or more issues become disputable by either party, then at such time this Agreement shall immediately terminate and a new Attorney-Client Retainer Agreement must be executed to conform to the newly developed disputed issues, with any deposited retainer to be refunded to the Client less attorney’s pro rata work and labor performed. This is a Limited Scope Representation and will expire immediately upon attorney successfully filing all executed documents related to a non-contested divorce. Attorney will forward by email to the client the Final Judgment of Divorce and/or any correspondence from the Court.

2. SCOPE OF ATTORNEYS DUTIES

Attorney accepts said employment and agrees to take such steps as are necessary to prepare documents and file executed documents with the Court for a non-contested divorce in Alabama.; said representation does not include any personal appearance in a Court Ordered hearing. Client hereby states none of the below apply and if so, this agreement is void. That:

  1. He/she is a minimum age of 19 years.
  2. One or both parties have been a resident of Alabama for a minimum period of 6 months preceding filing documents with the Court.
  3. No children exist of the parties to where paternity is a disputed issue.
  4. No spouse is making a claim to the other spouse’s retirement benefits that would therefore require a Qualified Domestic Relations Order (QDRO) to effect such division of title to respective account.
  5. That the ground’s for divorce do not include any ground outside of incompatibility of temperament to where the parties can no longer live together or there exists an irretrievable breakdown in the marriage and that further attempts at reconciliation are impractical or futile and not in the best interests of the parties or family.

3. CLIENTS DUTIES

Client agrees to be truthful with Attorneys, to provide all information requested so as to enable accurate documents to be prepared, to cooperate fully to all necessary requests, to timely return phone calls, to keep Attorney informed of developments, current address and telephone number, to abide by this Agreement, and to pay agreed fee on time.

4. FEES

(a). Attorneys shall receive fees as follows: Client shall pay those fees associated with the option of services chosen from this web site as and for representation as a flat fee retainer for Attorney services for preparing documents and filing with Court respective executed documents for an uncontested divorce.

(b). Client understands that the entire fee outlined in paragraph 4(a) above is a flat-fixed fee and is calculated at an hourly rate of $150.00 per hour.

5. COSTS

In addition to the fees quoted in paragraph 4(a) above, Client is also responsible for any and all costs to file documents with the Court which shall range from $210.00 to $250.00 depending on the County where it is filed.

6. COMMENCEMENT OF SERVICES

This Agreement will not take effect and Attorney is not bound to commence services until receipt by Attorney of all fees described in paragraph 4(a) above.

7. ENTIRE AGREEMENT

This agreement contains the entire agreement between Client and Attorney. No other agreement, statement or promise made on or before the effective date of this agreement will be binding on the parties. Client acknowledges that (1) he/she has read and understands the entire agreement; (2) client authorizes Attorney to lawfully dispose of clients file three years from the date this agreement is entered into which is the date of payment of attorney fees.
